Coverage rules

Some rules come from the statute and some from the endorsements on your own policy. Check your declarations page for the forms list.

WhatRuleSource
MatchingOn a homeowners policy, unless the policy says otherwise, when replaced items don't match in quality, color or size, the insurer must make reasonable repairs or replacements in adjoining areas. Many policies now cap matching at 1% of the dwelling limitFla. Stat. §626.9744
Roof: the old 25% ruleWhen 25% or more of a roof or roof section is being repaired, replaced or recovered, only that part must meet current code, if the existing roof was built to the 2007 Florida Building Code or laterFla. Stat. §553.844(5) (SB 4-D, 2022)
Hurricane deductibleInsurers must offer $500, 2%, 5% and 10% of the dwelling limit; it applies once per calendar yearFla. Stat. §627.701
Water damage limitMany policies cap non-weather water damage at $10,000. No Florida statute requires it; it comes from the policy formPolicy endorsement
MoldUsually excluded unless it results from a covered sudden water loss, and then capped by a separate sublimitPolicy terms

Disputes

Florida has a state mediation program, the appraisal clause in most policies, and a required notice before any lawsuit. Since the 2022 and 2023 reforms, a homeowner who sues generally can't recover their own attorney fees.

WhatRuleSource
State mediationFor disputes of $500 or more on personal and commercial residential policies. The insurer pays all costs ($350 for a residential mediation). You can back out of a settlement within 3 business days unless you've cashed or deposited the checkFla. Stat. §627.7015; Fla. Admin. Code 69J-166.031
AppraisalSettles how much, not whether; each side picks an appraiser, the two pick an umpire, and any two of the three set the amountPolicy appraisal clause; Parrish v. State Farm Florida (Fla. 2023)
Attorney feesNo one-way attorney fee awards remain for Florida property insurance suits: SB 2-A (2022) ended them and HB 837 (2023) repealed §627.428 and §626.9373Ch. 2022-271; ch. 2023-15, Laws of Fla.
