The New Jersey rules that decide a property insurance claim, in plain words, each with its source. Every topic links to our full guide. Last verified: October 26, 2026.
Claim deadlines
New Jersey sets the insurer's response times by regulation. Your own deadlines, including the time to sue, come mostly from your policy, so report a loss promptly and read the conditions section.
| What | Rule | Source |
|---|---|---|
| Insurer acknowledges your claim | Within 10 working days of notice | N.J.A.C. 11:2-17.6 |
| Insurer begins investigating | Within 10 working days of notice of the claim | N.J.A.C. 11:2-17.7 |
| Insurer pays the claim | Within 30 calendar days after it receives properly executed proofs of loss, unless a clear justification exists; if not, written notice and updates every 45 days | N.J.A.C. 11:2-17.7 |
| Insurer pays after you agree | Within 10 working days | N.J.A.C. 11:2-17.7 |
| File a lawsuit on the policy | Usually 12 months under the policy, counted from the loss but paused from the time you give notice until the insurer formally declines | Policy terms; Peloso v. Hartford Insurance Co., 56 N.J. 514 (1970) |
Your insurers
The state's homeowners market survey shows which insurer groups write the most New Jersey homeowners policies.
| What | Rule | Source |
|---|---|---|
| Largest by share of homeowners policies (12/31/2025) | State Farm 12.87% · NJM 12.81% · Allstate 8.05% · American Family (Homesite) 6.23% · Travelers 6.12% | NJ DOBI Homeowners Market Survey, 12/31/2025 |
| Insurer of last resort | New Jersey Insurance Underwriting Association (the FAIR Plan), for owners who can't get coverage from a standard insurer; basic property coverage | N.J.S.A. 17:37A-1 et seq. |
Coverage rules
New Jersey limits when a hurricane deductible may apply, and has no matching rule, so your policy wording decides. Winter perils like ice dams, frozen pipes and snow load are where most New Jersey coverage questions start.
| What | Rule | Source |
|---|---|---|
| Hurricane deductible | Applies only to a storm the National Weather Service named a hurricane, with sustained winds of 74 mph or more measured in New Jersey; the winds don't have to reach your property | N.J.A.C. 11:2-42.7; DOBI Bulletin 11-16 |
| Matching | No New Jersey statute or regulation sets a matching rule; it depends on your policy wording | N.J.A.C. 11:2-17 (no matching provision) |
Disputes
New Jersey has no state mediation program for homeowners claims today (the Sandy program ended in 2016). Disputes over the amount go to the policy's appraisal clause or to court within the policy's suit period, and the Department of Banking and Insurance takes consumer complaints.
| What | Rule | Source |
|---|---|---|
| Appraisal | Fire policies must include the standard appraisal provisions, which either side may demand: each picks a disinterested appraiser, and the two pick an umpire | N.J.S.A. 17:36-5.20 |
| State consumer help | New Jersey Department of Banking and Insurance, Consumer Inquiry and Response Center | nj.gov/dobi |
Condos and HOAs
New Jersey's post-Surfside law requires structural inspections of covered condo and co-op buildings and a reserve study for every association.
| What | Rule | Source |
|---|---|---|
| Structural inspections | First within 15 years of the certificate of occupancy (older buildings had 2 years from January 8, 2024), next within 10 years, then at the interval the inspector sets, never more than 5 years apart | P.L.2023, c.214 |
| Reserve study | At least every 5 years, with a 30-year funding plan; since 2025 a board may fund at 85% of the plan for up to 5 fiscal years after notice to owners | P.L.2023, c.214; P.L.2025, c.132 |
Public adjusters
Public adjusters are licensed by the Department of Banking and Insurance. New Jersey has no fixed fee percentage; the contract must state the maximum fee, and it must be reasonably related to the services.
| What | Rule | Source |
|---|---|---|
| License | State exam and a $10,000 bond; firms are licensed too | N.J.S.A. 17:22B; N.J.A.C. 11:1-37.8, 37.9 |
| Fee rule | The written contract must state the maximum fee, reasonably related to the services rendered | N.J.A.C. 11:1-37.13 |
| Contract and right to cancel (2025 law) | The written contract must list the adjuster's and firm's license numbers, the full fee and the services; you can cancel by midnight of the third business day, and refunds are due within 10 business days | P.L.2025, c.84 |
| Solicitation after a loss | No soliciting or signing a contract between 6 p.m. and 8 a.m. during the first 24 hours after a loss | N.J.A.C. 11:1-37.13 |
| Check a license | DOBI Licensee Search | www-dobi.nj.gov |
If your insurer fails
When a licensed New Jersey insurer fails, the New Jersey Property-Liability Insurance Guaranty Association (NJPLIGA) pays covered claims up to its cap. Surplus lines policies have a separate fund.
| What | Rule | Source |
|---|---|---|
| NJPLIGA limit | Covered claims under $300,000 per claimant, subject to your policy's deductible | N.J.S.A. 17:30A-1 et seq.; NJPLIGA notices |
| Surplus lines | Not covered by NJPLIGA; New Jersey has a separate Surplus Lines Insurance Guaranty Fund, $300,000 per occurrence | N.J.S.A. 17:22-6.74 |
