Fallen tree damage along a neighbor's property line

Not every property owner has insurance on the damage they’ve suffered, but that doesn’t automatically mean there’s no path to being made whole, if someone else caused the loss.

The basic idea

If another party’s negligence caused damage to your property, such as a neighbor’s fire that spread, a contractor’s work that went wrong, or a vehicle that struck your property, a claim against that responsible party’s own liability insurance may be possible, even though you have no policy of your own on the damage.

How this is different from a first-party claim

You’re not filing against your own insurer under your own policy, you’re pursuing the at-fault party’s liability coverage, which means the claim has to establish both that the damage happened and that the other party was responsible for it.

What helps a claim like this: clear documentation connecting the responsible party to the cause of the damage, photos and video of the loss itself, and any record, such as incident reports, witness information or the other party’s own insurance information if available, tying the event together.

Many property owners without insurance assume, understandably, that no insurance means no claim. Call Homeland to review a situation like this before assuming nothing can be done.

Frequently asked questions

Can I get paid for property damage if I don’t have insurance?
Possibly, if someone else caused it. If another party’s negligence damaged your property, a claim against that party’s liability insurance may be possible even though you have no policy of your own.
What do I need to prove in a claim against someone else’s insurance?
That the damage happened and that the other party was responsible for it. Documentation connecting them to the cause, photos and video of the loss, and records such as incident reports or witness information all help.
